Editorial : why not 3rd degree police Torture for Chief Minister Siddaramaiah and Movie star Darshan to elicit Truth ??
When a commonman , person is accused of theft , small crimes he is subjected to 3rd degree torture by police to elicit truth. Although 3rd degree torture is illegal , Police and others claim 3rd degree torture is must to elicit truth.
As per same police logic why not Chief Minister siddaramaiah and movie star darshan are subjected to 3rd degree torture by police to elicit truth in their respective cases ? Why this double standards by investigation officers ? IO himself must be subjected to interrogation.
Usually when a government official say a clerk is accused of a criminal offence he is immediately suspended from government service to prevent manipulation of evidences , records by him. Inspite of grave criminal accusations against chief Minister siddaramaiah he is continuing in his highly influential , powerful office. Apart from this one of the complainant in this case is facing life threats. Why this double standards ?
When a common prisoner faces any health issues , he is taken to nearby government hospital for treatment and kept in jail ward of hospital. no bail for treatment. However movie star darshan is given bail for medical treatment in outside private hospital. Why this double standards ?
Hope wisdom of legal statutes will dawn in police heads and will respect human rights of commoners just like they are respecting the human rights of siddaramaiah & darshan.
MUDA case: Activist accuses Lokayukta SP of dereliction of duty
Activist Snehamayi Krishna, the complainant in the MUDA land case which is being probed by the Lokayukta police, has accused the investigating officer of dereliction of duty.
Superintendent of Police, Lokayukta, T.J. Udesh had summoned Chief Minister Siddaramaiah on Wednesday to question him on the allotment of 14 sites by MUDA, to his wife Parvathi. But Mr. Krishna expressed his dismay over the manner in which the hearing was held and has written to the Additional Director-General of Police expressing his concerns.
The activist said though the investigating officer had summoned the other accused in the case, Mr. Siddaramaiah, who is named as A1 (accused no. 1) in the FIR, had not been summoned all these days. “But when the High Court of Karnataka listed our plea for transfer of case to the CBI, the Lokayukta issued a notice to the Chief Minister and questioned him in a hurry,” said Mr.Krishna.
What is intriguing is that the investigating officer fixed the time for hearing at around 9.30 a.m on Wednesday and the Chief Minister — who is being questioned and is an accused — decided on the time of conclusion of the hearing, as was evident in the day’s itinerary released by the Chief Minister’s office, said Mr. Krishna.
“Though there are hundreds of documents that need to be studied and Mr. Siddaramaiah need to be questioned on that all of which will take many days, the hearing has been concluded in less than two hours as per the time fixed by the accused in the case and this does not inspire confidence in the fairness of the probe by the Lokayukta police,” said Mr. Krishna who now plans to submit the same complaint to the High Court.

1. 2004ರಲ್ಲಿ ಕೆಸರೆ ಗ್ರಾಮದ 3.16 ಎಕರೆ ಭೂಮಿ ಮಂಜುನಾಥಸ್ವಾಮಿ ಎನ್ನುವವರ ಹೆಸರಿಗೆ ನೋಂದಣಿಯಾಗುತ್ತದೆ. ಅದು 2001ರಲ್ಲಿ ದೇವರಾಜ ಬಡವಾಣೆ ಎನ್ನುವ ಹೆಸರಿನಲ್ಲಿತ್ತು. ಆ ಹೆಸರಿನಲ್ಲಿ ಸೈಟು ಜನರಿಗೆ ಹಂಚಿಕೆ ಕೂಡಾ ಆಗಿತ್ತು. ಯಾರಿಗೋ ಹಂಚಿಕೆಯಾಗಿರುವ ಜಮೀನನ್ನು ತಮ್ಮ ಕುಟುಂಬದ ಕೃಷಿ ಜಮೀನು ಎಂದು ಮಾಡಿಸಿಕೊಳ್ಳಬಹುದೇ?
2. ವಿಧಾನಸೌಧ ಇರುವ ಜಾಗ ಹಿಂದೆ ನನ್ನ ಕೃಷಿ ಜಮೀನು ಆಗಿತ್ತು ಎಂದು ನಾನೇನಾದರೂ ದಾಖಲೆ ಕೊಟ್ಟರೆ ಮುಖ್ಯಮಂತ್ರಿಗಳು ಒಪ್ಪಿಕೊಳ್ಳುತ್ತಾರೆಯೇ? ಕೃಷಿಭೂಮಿ ಇಲ್ಲದೇ ಇರುವ ಜಾಗವನ್ನು ಕೃಷಿ ಜಮೀನು ಎಂದು ಮಾರಾಟ ಮಾಡಲು ಸಾಧ್ಯವೇ?
3. ನಿವೇಶನಗಳನ್ನು ಪಡೆದವರ ಹೆಸರಿನಲ್ಲಿ ಸಿಎಂ ಕಂದಾಯ ಕಟ್ಟುತ್ತಿದ್ದರೇ? ರಸ್ತೆ ಅಭಿವೃದ್ದಿ ಪಡಿಸಿ, ನಿವೇಶನ ಮಾಡಿ ಹಂಚಿರುವ ಜಾಗಕ್ಕೆ ಇವರು ಪರಿವರ್ತನೆ (ಕನ್ವರ್ಷನ್) ಮಾಡಿಕೊಡುತ್ತಾರೆಯೇ?
4. 2004ರಲ್ಲಿ ನೀವು ಖರೀದಿಸಿದಾಗ ಕೃಷಿಭೂಮಿ ಎಲ್ಲಿ ಇತ್ತು ಎಂದು ಸಿಎಂ ಹೇಳುತ್ತಾರಾ? ದೇವನೂರು ಬಡಾವಣೆ ವೀಕ್ಷಣೆಗೆ ತಹಶೀಲ್ದಾರರು, ಡಿಸಿಗಳು ಹೋಗಿದ್ದರೇ? ಆಗ ಅಲ್ಲಿ ಕೃಷಿಭೂಮಿ ಎಲ್ಲಿತ್ತು?
5. ಜಿಲ್ಲಾಧಿಕಾರಿಗಳು ಸ್ಥಳ ಪರಿಶೀಲನೆ ಮಾಡಿದ ವೇಳೆ ಸಿದ್ದರಾಮಯ್ಯನವರು ಡಿಸಿಎಂ ಆಗಿದ್ದರು. ಆಗ ಅವರು ತಮ್ಮ ಪ್ರಭಾವವನ್ನು ಬಳಸಲಿಲ್ಲವೇ? ಈ ಜಮೀನು ಡಿನೋಟಿಫೈ ಆದಾಗಲೂ ಅವರು ಉಪ ಮುಖ್ಯಮಂತ್ರಿ ಆಗಿದ್ದರು. ಇದರ ಬಗ್ಗೆ ಯಾಕೆ ತನಿಖೆ ಆಗಬಾರದು?
6. ಭ್ರಷ್ಟಾಚಾರ ತಡೆ ಕಾಯಿದೆಗೆ ಸಿಎಂ ಸಹಿ ಕಂಪಲ್ಸರಿ ಅಲ್ಲ, 2010ರಲ್ಲಿ ಗಿಫ್ಟ್ ಡೀಡ್ ಆದಾಗ ಕೃಷಿಭೂಮಿ ಎಂದು ನಮೂದು ಮಾಡುತ್ತಾರೆ. 2001ರಲ್ಲಿ ಬಡಾವಣೆ ಎಂದಿರುವ ಜಾಗವು, 2010ರಲ್ಲಿ ಕೃಷಿಭೂಮಿ ಆಗಲು ಸಾಧ್ಯವೇ?
7. ಸಿಎಂ ಅವರ ಭಾವಮೈದುನ ಖರೀದಿಸಿದ್ದು ಎನ್ನುವ ಜಮೀನು ಅಲ್ಲಿ ಇಲ್ಲವೇ ಇಲ್ಲ. ಇಲ್ಲದೇ ಇರುವ ಭೂಮಿಗೆ ಪರಿಹಾರ ರೂಪದಲ್ಲಿ ನಿವೇಶನ ಹಂಚಿಕೆ ಮಾಡಿಸಿ ಕೊಂಡಂತಾಗುವುದಿಲ್ಲವೇ?
8. ಜಮೀನನ್ನು ವಾಪಸ್ ಮುಡಾಗೆ ಬಿಟ್ಟು ಕೊಡಬೇಕಾ ಎಂದು ಸಿದ್ದರಾಮಯ್ಯ ಪ್ರಶ್ನಿಸಿದ್ದರು ಇಲ್ಲದೇ ಇರುವ ಜಮೀನಿಗೆ ಪರಿಹಾರ ಹೇಗೆ ಪಡೆದರು? ಜನಸಾಮಾನ್ಯರಿಗೆ ಇದು ಸಾಧ್ಯವೇ?
9. ರಾಜ್ಯಪಾಲರಿಗೆ ಸುದೀರ್ಘವಾಗಿ ವಿವರಣೆಯನ್ನು ನೀಡಿದ್ದೇನೆ, ನಂತರವಷ್ಟೇ ರಾಜ್ಯಪಾಲರು ನೋಟಿಸ್ ಕೊಟ್ಟಿದ್ದಾರೆ. ನೋಟಿಸ್ ಕಾನೂನುಬದ್ದವಾಗಿಯೇ ಇದೆಯಲ್ಲವೇ?
10. ಇದೊಂದು ರಾಜಕೀಯ ಪ್ರೇರಿತ ಎನ್ನುವುದು ಕಾಂಗ್ರೆಸ್ಸಿಗರ ಆರೋಪ. ದೂರಿನ ಜೊತೆಗೆ ಕೋರ್ಟ್ ಸರ್ಕ್ಯೂಲರ್ ಕೂಡಾ ಲಗತ್ತಿಸಿದ್ದೆ. ಆ ಪ್ರಕಾರವೇ ನಾನು ರಾಜ್ಯಪಾಲರನ್ನು ಭೇಟಿಯಾಗಿರುವುದು. ಕಾನೂನು ಪ್ರಕಾರವೇ ನಡೆದುಕೊಂಡಿದ್ದೇನೆ, ಸಿದ್ದರಾಮಯ್ಯ ಸರ್ಕಾರದ ಮಂತ್ರಿಗಳು ಕಣ್ಣುಮುಚ್ಚಿಕೊಂಡಿದ್ದರೆ ಅದು ನನ್ನ ತಪ್ಪೇ ?

ಕರ್ನಾಟಕ ಕೈಗಾರಿಕಾ ಪ್ರದೇಶಾಭಿವೃದ್ಧಿ ಮಂಡಳಿ (ಕೆಐಎಡಿಬಿ)ಗೆ ಸಂಬಂಧಿಸಿದ ಭ್ರಷ್ಟಾಚಾರ ಪ್ರಕರಣದಲ್ಲಿ ಲೋಕಾಯುಕ್ತ ಅಧಿಕಾರಿಯ ಕಳಪೆ ತನಿಖೆಯಿಂದಾಗಿ ಆರೋಪಿಗಳನ್ನು ಖುಲಾಸೆಗೊಳಿಸುವಾಗ ನ್ಯಾಯಾಧೀಶರು ಈ ರೀತಿ ಅಭಿಪ್ರಾಯಪಟ್ಟಿದ್ದಾರೆ.
ಬೆಂಗಳೂರು: ಲೋಕಾಯುಕ್ತ ವಿಶೇಷ ನ್ಯಾಯಾಲಯವು ಹಲವಾರು ಪ್ರಕರಣಗಳಲ್ಲಿ ಕೆಟ್ಟ ರೀತಿಯಲ್ಲಿ ತನಿಖೆ ನಡೆಸಿ ಆರೋಪಿಗಳನ್ನು ಖುಲಾಸೆಗೊಳಿಸಿದೆ. ಭ್ರಷ್ಟಾಚಾರ ನಿಗ್ರಹ ದಳದ ಪೊಲೀಸ್ ಅಧಿಕಾರಿಗಳು ಪ್ರಮುಖ ಪ್ರಕರಣಗಳಲ್ಲಿ ‘ಬಿ’ (ಮುಚ್ಚುವಿಕೆ) ರಿಪೋರ್ಟ್ ಸಲ್ಲಿಸುವಷ್ಟು ದಿಟ್ಟತನ ತೋರಿದ್ದಾರೆ ಎಂದು ಭ್ರಷ್ಟಾಚಾರ ತಡೆ ಕಾಯ್ದೆಯಡಿ ದಾಖಲಾಗಿರುವ ಪ್ರಕರಣಗಳ ವಿಚಾರಣೆ ನಡೆಸುತ್ತಿರುವ ನ್ಯಾಯಾಧೀಶ ಕೆ.ಎಂ.ರಾಧಾಕೃಷ್ಣ ಅಭಿಪ್ರಾಯ ಪಟ್ಟಿದ್ದಾರೆ.
ಪ್ರಮುಖ ಆರೋಪಿಗಳು ಮತ್ತು ಪ್ರಭಾವಿ ಅಧಿಕಾರಿಗಳ ಪರವಾಗಿ ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸ್ ಅಧಿಕಾರಿಗಳು ಕೆಲಸ ಮಾಡುತ್ತಿದ್ದಾರೆ. ಅಧಿಕಾರಿಗಳು ವಿರುದ್ಧ ನೇರ ಆರೋಪ ಮತ್ತು ಆರೋಪ ಕೇಳಿ ಬಂದಿರುವ ಅಧಿಕಾರಿಗಳ ಪ್ರಕರಣಗಳನ್ನು ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರು ನಿರ್ಲಕ್ಷಿಸುತ್ತಿದ್ದಾರೆ ಎಂದು ನ್ಯಾಯಾಲಯ ಹೇಳಿದೆ.
ಅವರು ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿ ಆಪಾದಿತ ಅಧಿಕಾರಿಗಳಿಗೆ ಸಹಾಯ ಮಾಡಲು ಮತ್ತು ಕೇವಲ ಹೆಸರಿಗಾಗಿ ಮಾತ್ರ ಆರೋಪಪಟ್ಟಿ ಸಲ್ಲಿಸುತ್ತಾರೆ. ಅಧೀನ ಅಧಿಕಾರಿಗಳಿಗೆ ಸಹಾಯ ಮಾಡಲು ಸಮರ್ಥರಲ್ಲದ ಅಧಿಕಾರಿಗಳಿಂದ ಪ್ರಾಸಿಕ್ಯೂಷನ್ ಮಂಜೂರಾತಿ ಆದೇಶಗಳನ್ನು ಪಡೆಯುತ್ತಿದ್ದಾರೆ ಎಂದು ಕಟುವಾಗಿ ನುಡಿದಿದ್ದಾರೆ.
ಮುಖ್ಯಮಂತ್ರಿ ಸಿದ್ದರಾಮಯ್ಯ, ಅವರ ಪತ್ನಿ ಪಾರ್ವತಿ ಬಿಎಂ ಮತ್ತು ಇತರರನ್ನು ಒಳಗೊಂಡಿರುವ ಮುಡಾ ನಿವೇಶನ ಹಂಚಿಕೆ ಪ್ರಕರಣದ ತನಿಖೆಯನ್ನು ನಡೆಸುತ್ತಿರುವ ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸರ ವಿಶ್ವಾಸಾರ್ಹತೆ ಮತ್ತು ಔಚಿತ್ಯದ ಬಗ್ಗೆ ಪ್ರಶ್ನೆಗಳು ಎದ್ದಿರುವ ಸಮಯದಲ್ಲಿ ಈ ಮಾತುಗಳು ಕೇಳಿ ಬಂದಿವೆ.
ವಿಶೇಷವಾಗಿ ಲೋಕಾಯುಕ್ತ ಪೊಲೀಸ್ ವಿಭಾಗಕ್ಕೆ ಸುಶಿಕ್ಷಿತ, ಪ್ರಾಮಾಣಿಕ ಮತ್ತು ಸಮರ್ಥ ಪೊಲೀಸ್ ಅಧಿಕಾರಿಗಳನ್ನು ನೇಮಿಸಬೇಕು. ಅಕ್ರಮ ಗಣಿಗಾರಿಕೆ ತನಿಖೆ ನಡೆಸುತ್ತಿರುವ ವಿಶೇಷ ತನಿಖಾ ತಂಡ (ಎಸ್ಐಟಿ), ಕೇಂದ್ರ ಅಪರಾಧ ವಿಭಾಗ (ಸಿಸಿಬಿ) ಮತ್ತು ಅಪರಾಧ ತನಿಖಾ ಇಲಾಖೆಗೆ ನಿಯೋಜಿಸಬೇಕೆಂದು ನಾನು ಬಯಸುತ್ತೇನೆ. ಪರಿಣಾಮಕಾರಿ ತನಿಖೆ ಹಾಗೂ ನಿಜವಾದ ಅಪರಾಧಿಗಳಿಗೆ ಶಿಕ್ಷೆ ನೀಡು ಅವಶ್ಯಕತೆಯಿದೆ ಎಂದು ಹೇಳಿದ್ದಾರೆ.
ಅಂಕಿಅಂಶಗಳ ಉದ್ದೇಶಗಳಿಗಾಗಿ ವಿವಿಧ ಅಪರಾಧಗಳಿಗೆ ನೂರಾರು ಪ್ರಕರಣಗಳನ್ನು ದಾಖಲಿಸುವುದು ನಿಜವಾದ ಉದ್ದೇಶವನ್ನು ಪೂರೈಸುವುದಿಲ್ಲ. ಅಂತಹ ಪ್ರಕರಣಗಳು ಸಮಾಜಕ್ಕೆ ನ್ಯಾಯವನ್ನು ಒದಗಿಸುವ ಬದಲು ಅನ್ಯಾಯಕ್ಕೆ ಕಾರಣವಾಗುತ್ತವೆ ಎಂಬುದು ನನ್ನ ಅಭಿಪ್ರಾಯ ಎಂದಿದ್ದಾರೆ.

ಎಸಿಬಿ, ಲೋಕಾಯುಕ್ತ ಕಾರ್ಯವೈಖರಿಗೆ ನ್ಯಾಯಾಲಯ ಕಿಡಿ:

ಭ್ರಷ್ಟಾಚಾರದಲ್ಲಿ ತೊಡಗಿರುವ ಅಧಿಕಾರಿಗಳ ಮೇಲೆ ಎಸಿಬಿ, ಲೋಕಾಯುಕ್ತ ದಾಳಿ ನಡೆಸುವುದೇನೋ ಸರಿ. ಆದರೆ ಬಳಿಕ ಪ್ರಕರಣ ಏನಾಗುತ್ತದೆ? ಇಲ್ಲಿ ಅಕ್ರಮದಲ್ಲಿ ಭಾಗಿಯಾದ ಆರೋಪ ಹೊತ್ತಿರುವ ಸರ್ಕಾರಿ ನೌಕರರು, ಅಧಿಕಾರಿಗಳಿಗೆ ಮುಂದೆ ತನಿಖಾಧಿಕಾರಿಗಳು ಕ್ಲೀನ್ಚಿಟ್ ನೀಡುತ್ತಾರೆ.
ಮಧ್ಯವರ್ತಿಗಳು ಮಾತ್ರವೇ ಸಿಕ್ಕಿಬೀಳುತ್ತಾರೆ ಎಂದು ಲೋಕಾಯುಕ್ತ ನ್ಯಾಯಾಲಯ ಅಸಮಾಧಾನ ವ್ಯಕ್ತಪಡಿಸಿದೆ.

2016ರಲ್ಲಿ ಕೆಐಎಡಿಬಿ ಕಚೇರಿಯಲ್ಲಿ ನಡೆದ ಭ್ರಷ್ಟಾಚಾರ ಆರೋಪದ ಕೇಸನ್ನು ಎಸಿಬಿ ನಿರ್ವಹಿಸಿರುವ ಕುರಿತಂತೆ ಸೆ.30ರಂದು ಆದೇಶ ಪ್ರಕಟಿಸಿರುವ ನ್ಯಾ. ಕೆ.ಎಂ. ರಾಧಾಕೃಷ್ಣ ಅವರು, ತನಿಖಾಧಿಕಾರಿ ಕೆಐಎಡಿಬಿ ಅಧಿಕಾರಿಗಳಿಗೆ ಕ್ಲೀನ್ಚಿಟ್ ಕೊಟ್ಟು ಮಧ್ಯವರ್ತಿಗಳನ್ನು ಮಾತ್ರವೇ ಆರೋಪಿಗಳನ್ನಾಗಿ ಪರಿಗಣಿಸಿದ್ದ ವಿಚಾರ ಗಂಭೀರವಾಗಿ ಪರಿಗಣಿಸಿದ್ದಾರೆ. ಇದು ತನಿಖಾಧಿಕಾರಿಗಳ ಕಳಪೆ ತನಿಖೆಯನ್ನು ಬೊಟ್ಟು ಮಾಡಿದೆ.
ಟ್ರ್ಯಾಪ್ ಮಾಡಿ ಸಿಕ್ಕಿಬಿದ್ದ ಸರಕಾರಿ ನೌಕರರ ವಿರುದ್ಧವೂ 'ಬಿ' ರಿಪೋರ್ಟ್ ಸಲ್ಲಿಸುವ ಧೈರ್ಯ ತನಿಖಾಧಿಕಾರಿಗಳಿಗೆ ಎಲ್ಲಿಂದ ಬರುತ್ತಿದೆ. ಪ್ರಮುಖ, ಪ್ರಭಾವಿಗಳ ವಿರುದ್ಧದ ಆರೋಪಗಳನ್ನು ಕೈ ಬಿಟ್ಟು ಚಾರ್ಜ್ಶೀಟ್ ಸಲ್ಲಿಸಲಾಗುತ್ತಿದೆ. ಜತೆಗೆ, ಉದ್ದೇಶಪೂರ್ವಕವಾಗಿಯೇ ಸಕ್ಷಮ ಪ್ರಾಧಿಕಾರಗಳಿಂದ ಅಭಿಯೋಜನಾ ಮಂಜೂರಾತಿ ಪಡೆಯುತ್ತಿಲ್ಲ. ಹೀಗಾಗಿ ಆರೋಪಿಗಳು ಖುಲಾಸೆಯಾಗುತ್ತಿದ್ದಾರೆ ಎಂದು ನ್ಯಾಯಾಧೀಶರು ಕಿಡಿಕಾರಿದ್ದಾರೆ.
'ಅಂಕಿ-ಅಂಶಗಳ ಕಾರಣಕ್ಕಾಗಿ ನೂರಾರು ಕೇಸ್ ದಾಖಲಿಸಿದರೆ ಸಂತ್ರಸ್ತರಿಗೆ ನ್ಯಾಯ ಸಿಗುವುದಿಲ್ಲ. ಬದಲಿಗೆ ಪಾರದರ್ಶಕ, ನ್ಯಾಯಯುತ ತನಿಖೆ ನಡೆಸಬೇಕು. ನೈಜ ಆರೋಪಿಗಳನ್ನು ಪತ್ತೆ ಹಚ್ಚಿ ಶಿಕ್ಷೆ ಕೊಡಿಸುವ ಕೆಲಸವಾಗಬೇಕು,'' ಎಂದು ಆದೇಶದಲ್ಲಿ ತಿಳಿಸಿದ್ದಾರೆ.
ಪ್ರಕರಣ ಏನು?
ನೆಲಮಂಗಲ ತಾಲೂಕು ಸೋಂಪುರ ಹೋಬಳಿಯಲ್ಲಿ ಕೆಐಎಡಿಬಿ ಸ್ವಾಧೀನಪಡಿಸಿಕೊಂಡಿದ್ದ ಭೂಮಿಗೆ ಪರಿಹಾರ ನೀಡುವಲ್ಲಿ ಮಧ್ಯವರ್ತಿಗಳ ಮೂಲಕ ಅಧಿಕಾರಿಗಳು ರೈತರಿಂದ ಶೇ.10ರಷ್ಟು ಕಮಿಷನ್ ಪಡೆಯುತ್ತಿರುವ ವ್ಯಾಪಕ ದೂರಿನ ಹಿನ್ನೆಲೆಯಲ್ಲಿ 2019ರ ಅ.15ರಂದು ಖನಿಜ ಭವನದ ಕೆಐಎಡಿಬಿ ಕಚೇರಿಯಲ್ಲಿ ಎಸಿಬಿ ಅಧಿಕಾರಿಗಳು ಶೋಧ ನಡೆಸಿದ್ದರು. ದಾಳಿ ವೇಳೆ 12,90,620 ರೂ. ಅನಧಿಕೃತ ಹಣ ಜಪ್ತಿ ಮಾಡಿದ್ದರು. ಈ ಪ್ರಕರಣದಲ್ಲಿ 9 ಮಂದಿ ಮಧ್ಯವರ್ತಿಗಳನ್ನು ಬಂಧಿಸಲಾಗಿತ್ತು.
ಪ್ರಕರಣದ ತನಿಖೆ ನಡೆಸಿದ್ದ ಡಿವೈಎಸ್ಪಿ ಸಿ. ಬಾಲಕೃಷ್ಣ ಆರೋಪಿಗಳ ವಿರುದ್ಧ ಭ್ರಷ್ಟಾಚಾರ ನಿಯಂತ್ರಣ ಕಾಯಿದೆ ಕಲಂ 7 (ಎ) 420ರ (ವಂಚನೆ) ಅನ್ವಯ ನ್ಯಾಯಾಲಯಕ್ಕೆ ದೋಷಾರೋಪ ಪಟ್ಟಿ ಸಲ್ಲಿಸಿದ್ದರು.
ಪ್ರಕರಣ ವಿಚಾರಣಾ ಹಂತದಲ್ಲಿ ಆರೋಪಿಯೊಬ್ಬ ಆರೋಪದಿಂದ ಮುಕ್ತನಾಗಿದ್ದ. ಉಳಿದ ಎಂಟು ಮಂದಿ ಆರೋಪಿಗಳ ವಿರುದ್ಧ ವಿಚಾರಣೆ ಪೂರ್ಣಗೊಂಡಿದೆ. ಸಾಕ್ಷ್ಯಾಧಾರಗಳ ಕೊರತೆ ಹಾಗೂ ಭ್ರಷ್ಟಾಚಾರ ನಿಯಂತ್ರಣ ಕಾಯಿದೆ ಕಲಂ 7 (ಎ) ಅನ್ವಯ ಸರಕಾರಿ ಅಧಿಕಾರಿಯೊಬ್ಬನ ಜತೆ ಖಾಸಗಿ ವ್ಯಕ್ತಿ ಶಾಮೀಲಾದರೆ ಮಾತ್ರವೇ ಶಿಕ್ಷೆಗೆ ಅರ್ಹನಾಗಲಿದ್ದಾನೆ. ಉಳಿದಂತೆ ಖಾಸಗಿ ವ್ಯಕ್ತಿಗಳಿಗೆ ಈ ಕಲಂ ಅನ್ವಯವಾಗುವುದಿಲ್ಲ.
ಆದರೆ, ಈ ಕೇಸ್ನಲ್ಲಿ ಸರಕಾರಿ ಅಧಿಕಾರಿ ಆರೋಪಿಯೇ ಆಗಿರಲಿಲ್ಲ. ಈ ಅಂಶಗಳನ್ನು ಆರೋಪಿಗಳ ಪರ ವಕೀಲರು ವಾದಿಸಿದ್ದರು.
ವಾದ-ಪ್ರತಿವಾದ ಆಲಿಸಿದ್ದ ನ್ಯಾಯಾಲಯ, ಆರೋಪಿಗಳನ್ನು ಖುಲಾಸೆಗೊಳಿಸಿ ಸೆ.30ರಂದು ಆದೇಶ ಹೊರಡಿಸಿದೆ. ಆದೇಶದಲ್ಲಿತನಿಖಾ ಲೋಪಗಳನ್ನು ಎತ್ತಿಹಿಡಿದಿದ್ದು ಆದೇಶ ಪ್ರತಿ 'ವಿಕ'ಗೆ ಲಭ್ಯವಾಗಿದೆ.
ಡಿವೈಎಸ್ಪಿಗೆ ನೋಟಿಸ್
ಖನಿಜ ಭವನದ ಕೆಐಎಡಿಬಿ ಅಧಿಕಾರಿಗಳ ಕಚೇರಿ ಹಾಗೂ ಮಧ್ಯವರ್ತಿಗಳ ಬಳಿ ಅನಧಿಕೃತವಾಗಿ ದೊರೆತಿದ್ದ 12,90,620 ರೂ. ಜಪ್ತಿ ಹಣದ ಕುರಿತು ಸಮರ್ಪಕ ತನಿಖೆ ನಡೆಸದ ಕಾರಣ ಆರೋಪಿಗಳಾಗಿದ್ದ ಮಧ್ಯವರ್ತಿಗಳು ಖುಲಾಸೆಗೊಂಡಿದ್ದಾರೆ. ಈ ಕಾರಣಕ್ಕೆ ಗಂಭೀರ ತನಿಖಾ ಲೋಪವೆಸಗಿರುವ ಸಂಬಂಧ ನಿಮ್ಮ ವಿರುದ್ಧ ಏಕೆ ಶಿಸ್ತು ಕ್ರಮ ಜರುಗಿಸಬಾರದು ಎಂಬುದಕ್ಕೆ ಮುಂದಿನ 15 ದಿನದಲ್ಲಿ ಖುದ್ದು ಹಾಜರಾಗಿ ವಿವರಣೆ ನೀಡಬೇಕು ಎಂದು ಪ್ರಕರಣದ ತನಿಖಾಧಿಕಾರಿ ಹಿಂದಿನ ಎಸಿಬಿ ಡಿವೈಎಸ್ಪಿ ಸಿ.ಬಾಲಕೃಷ್ಣ (ಹಾಲಿ ಕಬ್ಬನ್ ಪಾರ್ಕ್ ಉಪವಿಭಾಗದ ಡಿವೈಎಸ್ಪಿ)ಗೆ ನ್ಯಾಯಾಲಯ ಶೋಕಾಸ್ ನೋಟಿಸ್ ಜಾರಿಗೊಳಿಸಿದೆ.

Karnataka: FIR filed by Lokayukta in MUDA scam fails to mention names of accused officers, finger of suspicion raised
MYSURU: The Congress-led Karnataka government, specifically Chief Minister Siddaramaiah, is facing accusations of misusing power following the rapid return of 14 replacement plots sanctioned by the Mysore Urban Development Authority (MUDA) to his wife, Parvathy Siddaramaiah. The speed at which this process was executed has raised eyebrows, with critics pointing to potential bureaucratic influence and lapses.
The incident came to light when MUDA officials swiftly processed Parvathy’s request to return the plots. Within hours, all necessary procedures were completed, sparking widespread speculation that CM Siddaramaiah had influenced the officials involved. Many in bureaucratic circles have hinted that such efficiency is unusual and likely driven by political power.
Additionally, the Lokayukta police registered an FIR naming Siddaramaiah and his family members but conspicuously excluded any MUDA officials, who are also believed to be involved. This selective omission has fueled speculation that Siddaramaiah’s influence was exercised not just over MUDA but also over the Lokayukta investigation.
The lapses in following the rules by MUDA are glaring. Parvathy’s request to return the 14 plots was accepted and processed hastily, bypassing the standard procedures. Critics argue that this points to a clear abuse of power, as ordinary citizens face prolonged delays in similar cases.
Moreover, the Lokayukta’s FIR failed to include the names of district, taluk, and MUDA officials who were allegedly involved in allocating the plots illegally. These officials played a crucial role in executing the irregular land deals, yet none of their names appeared in the FIR. This omission has raised serious questions about the transparency and integrity of the investigation, with suggestions that pressure from Siddaramaiah may have influenced the process.
The case has also highlighted MUDA’s historical lapses in managing land acquisitions and allotments. In 1998, land adjacent to agricultural plots was recommended for de-notification, with officials allegedly involved in manipulating land use. Despite their involvement in the scandal, none of these officials have been named or implicated in the case.
The accusations extend further.
Some argue that the MUDA engineers and commissioners, who were responsible for misusing unacquired land for site development after 2010, are also complicit. Senior officers have indicated that this land does not belong to MUDA, but it was developed using MUDA funds—another violation that has yet to be addressed.
Furthermore, there is mounting suspicion that the illegal distribution of plots by MUDA in unacquired land, and the subsequent allocation of prestigious sites to Parvathy instead of equivalent plots, caused significant financial losses to the exchequer. Despite this, the names of the involved officers remain absent from the FIR.
A senior official suggested that this could be an intentional move to protect Siddaramaiah. The fear is that implicating these officers could open doors to further investigation into Siddaramaiah’s involvement, as these officials may expose the full extent of political influence in the scandal.
The Lokayukta police have recently intensified their investigation, with Special Lokayukta SP Udesh conducting local inspections at the 14 sites in Vijayanagar and elsewhere. This comes after the Enforcement Directorate (ED) summoned complainant Snehamai Krishna to provide key documents related to the case.
Though Siddaramaiah’s wife has voluntarily returned the plots, this move is seen by the complainant and other critics as an attempt to mitigate the legal consequences rather than an admission of guilt. As the investigation deepens, the Congress government faces increasing pressure to account for these alleged lapses and misuse of power.

in & around mysore city , high tension electric lines are there in busy residential areas . as per Indian electricity act , no permanent structures should be under the HT lines. However there are buildings under it. In some places , HT lines runs in the middle of the road. The authorities Have developed those areas beneath HT lines as parks , rented out
advertisement spaces & built permanent fencing of those areas spending lakhs of taxpayer's money. This fencing obstructs the movement of service personnel of
electricity board , to service HT line. Are all these structures under & surrounding HT lines legal ?

around mysore city , vast areas of village farm lands , agricultural lands are acquired by private real estate developers for non agricultural purposes by a single firm or single owner. Are these actions legal ? some of these real estate agents have sold those lands to private industries , multinational companies for crores of rupees. Has the MUDA / MCC /
GOVERNMENT given alienation of land ie conversion from agricultural to industrial usage. Has KIADB given consent to it ?
can a single individual / firm can purchase such vast tracts of agricultural lands , is it legal ? is it within the KIADB's comprehensive industrial area development plan ?

while auctioning off the lands of sick industrial unit M/S IDEAL JAWA LTD , was there any pre-qualification to bidders that after purchase of lands only it must be used for industrial use or only industries can participate in the bidding process ?

how many trusts , NGOs are allotted prime residential / commercial lands by MUDA / MCC / GOVERNMENT on lease basis , in turn the said trusts , NGOs have sulet it either partly or wholly to others ?
how many such lease allotments are sold by MUDA / MCC / GOVERNMENT before the expiry of lease period , without public auction ?
what are the norms followed by MUDA / MCC / GOVERNMENT for the sale of leased lands to the lessee before the expiry of lease period ?
To my previous rti requests and appeals PIOs of MUDA , BDA , BBMNP , KIADB & MCC gave half truth information to few questions and for most questions didn't answer. denial of information by PIOs helped crime cover ups and aided criminals to escape & commit more crimes unabated. Crime cover up and aid to crime in itself is one more crime. Why should not respective PIOs be legally prosecuted for the same.

shopping malls, movie theatres are supposed to provide for visitor’s vehicle parking in their buildings plan itself. Still they charge parking fees to visitors, is it legal ? have you identified such cases ?
Many business complexes have shown the cellar in building plan as meant for vehicle parking , but they have illegally constructed shops in cellar and rented out that too. Is it not illegal ? Have you identified such cases ?

- Are BDA , MUDA , Karnataka HC Judges favoring Land Mafia & Murdering Innocents ?
Recently Karnataka high court gave clearance to Karnataka government’s regularization of illegal buildings ( AKRAMA SAKRAMA ) scheme.
1. Law is one & same for all.
2. Government authorities , police razes down , demolishes small temporary hutments built by tribals , dalits without mercy , takes suo motto action. No court comes to their rescue.
3. Till date bagar hukum lands are not given to dalits , tribals are not given land rights over their huts in forests. Is Cout blind , deaf ?
4. However when rich crooks build bungalows , commercial complexes illegally , no suo motto action taken by government authorizes , police , why ? Courts go a step further it gives stay orders against demolition of rich crook’s illegal buildings , asks government to modify plan , law itself to save illegal buildings of rich crooks.
5. Does Karnataka HC has details of exact number of building violations , buildings built on forest lands , lake beds , raja kaluves with respective after affects on neighbouring buildings , road traffic , ecology , etc and contingency plan by authorities to overcome those after affects casewise backed by technical studies. Make it public.
6. What criminal action initiated against revenue , police & other officials who failed in their duties at the first instance to stop the illegal building construction.
7. Small houses of poor people who have smaller building violations but who failed to bribe officials were dealt mercilessly. Their houses were razed down . Now , will the HC order the government to compensate them , to rebuild houses for them as the court is now saying they are legal now.
8. Government & HC has given a cut off date for consideration of regularization of illegal buildings. When a crime before that cut off date becomes legal , why cann’t it be legal after that date ?
9. What guarantee HC gives no illegal buildings has come up after cut off date and will never come in future ?
10. If comes what criminal action against the concerned officials ?
11. The land encroachments & illegal buildings and it’s continued existence since years is not possible without tacit , covert support of jurisdictional revenue officials. What disciplinary action has been taken against concerned officials with respect to each case of land encroachment & illegal buildings , case wise ?
12. If not , why ?
13. Is not “land AKRAMA SAKRAMA SCHEME” itself illegal ?
14. Is not the move of government of Karnataka to legalise land encroachments & illegal buildings , in itself illegal ?

1. Facts of the case:
Judges Murder Innocents
In the recent past , in bangalore city & other parts of karnataka incessant rains played havoc on civilians. Due land grabbings , lake grabbings , lake tributaries grabbings by land mafia rain water entered many houses killing civilians , livestock and caused crores of rupees losses.
There are many statutory reports by A T Ramaswamy , Subramanyam , Koliwad , etc regarding lake encroachments , raaja kaluve / tributaries encroachment , revenue land / forest land encroachment , etc. What is the action taken by government ?
Authorities enacted lake encroachment clearance drama by clearing / demolishing commoner’s houses on the fringes , when it came to big bungalows of ministers , crores of worth apartment clusters , it stopped all of a sudden.
In the same way , Authorities enacted Raaja Kaluve / tributaries encroachment clearance drama by clearing / demolishing commoner’s houses on the fringes , when it came to big bungalows of rich , commercial complexes , crores of worth apartment clusters , it stopped all of a sudden.
A Karnataka High Court Judge was shame less in his act to favor the rich. That judge was not moved , sympathetic when small hutments , small houses of poor were demolished. He became wise when authorities wanted to demolish big bungalows , commercial complexes of rich. He asked BDA , BBMNP why cann’t authorities divert Raaja Kaluve itself ?
Wise Judge Sir , one has to buy pant , shirt according to his height , waist , etc but you cann’t change your body size , height , waist according to size of shirt or pant ? One has to build house , complex based on plan given by the authorities leaving aside civic / revenue lands. It is a grave crime by both seller & buyer of that illegal encroached land , irrespective of rich or poor , commoner or minister, those lake encroachments , Raaja Kaluve encroachments must be removed & guilty severely punished.
Authorities & few judges are hand in glove with land mafia and are not acting against rich , powerful violators. Since years we are requesting for information under RTI about land grabbings from MUDA , MCC , BBMNP . BDA , KIADB no answer ? Appealed to courts , no use. Years back , when we questioned a Judge / District Magistrate about hebbal lake encroachment , he threatened me personally over phone.
The recent move of Government of Karnataka to legalize illegal land encroachments ( AKRAMA SAKRAMA ) iself is illegal. If timely action was taken by SCI Judges & Karnataka HC Judges these losses could have been averted. Due to this unholy nexus , negligence of duties even by judges resulted in loss of lives , properties in karnataka during recent rains. The guilty judges must also be punished.
Who will bell the cat.
Specifically in Karnataka Rich & Influential people have illegally encroached Lakes , Public grazing fields , Temple Lands , Raaja Kaluve / feeder canals , etc. Concerned public servants are not doing their duties and encroachment continues since years. Even appeals to Law Courts of Justice by way of PILs have not yielded any results. Even criminal nexus with help of government has gone a step further to legalize their crimes of land grabbing in the name of “AKRAMA SAKRAMA”. Courts are deaf , dumb & blind.
These crimes can continue since years only with connivance of judges , public servants. Throughout this petition term “Judge” includes even quasi judicial officers like Revenue Inspector , Assistant Commissioner , District Magistrate , etc apart from Law Court Judges.
Due to these illegal land encroachments , road accidents are taking place , buildings are falling down , rain water is gushing into houses and killing people. For all the recent deaths due to rains in Bengaluru & other parts of Karnataka JUDGEs are solely responsible. For all these JUDGEs are responsible.

Is robbing another’s property right , legal ? is robbing land , lake – a public property for private , individual use right ?
3. Grounds:
Requests for equitable justice , Criminal Prosecution of Judges , master minds of land grabbing ,frauds.

Hereby , I do request the honorable supreme court of India to consider this as a PIL for : “writ of Mandamus” and to issue instructions to the concerned public servants in the following cases to perform their duties & to punish guilty judges.
The Petitioner has sent many letters / appeals / petitions to supreme court of india & other courts through e-mail , DARPG website & through regular mail requesting them to consider those as PILs. But none of them were admitted , even acknowledgement for receipts were not given. See How duty conscious ,our judges are & see how our judges are sensitive towards life , liberty of citizens , commonmen & see how careless our judges are towards anti national crimes , crimes worth crores of rupees. That the present petitioner has not filed any other petition (which are admitted by courts) in any High Court or the Supreme Court of India on the subject matter of the present petition.

In the above premises, it is prayed that this Hon'ble Court may be pleased:
