PETITION UNDER ARTICLE 12 to ARTICLE 35 & ARTICLE 51A OF THE CONSTITUTION OF INDIA FOR ISSUANCE OF A WRIT IN THE NATURE OF MANDAMUS UNDER ARTICLE 32 & ARTICLE 226 OF THE CONSTITUTION OF INDIA.

MOST RESPECTFULLY SHOWETH :
1. Facts of the case:
"Power will go to the hands of rascals, ,
rogues and freebooters. All Indian leaders will be of low calibre and men of straw. They will have sweet tongues and silly hearts. They will fight among themselves for power and will be lost in political squabbles . A day would come when even air & water will be taxed."
Sir Winston churchill made this statement in the House of Commons just before the independence of India & Pakistan. Sadly , the forewarning of Late Winston Churchill has been proved right by some of our criminal , corrupt public servants.
We common people would have been happy if churchill's forewarning was proved wrong. Sadly he was proved right.
In the past we have seen violent physical fights within legislative assemblies during session , disrobing women members , viewing pornography in the assembly , etc. When criminals enter politics this is the end result.
We have utmost heartfelt respects to honest few in judiciary , police & public service. We SALUTE them. Our effort here is to bring errant public servants to book.
Democracy is relatively best form of governance, compared to monarchy , communism , dictatorship. The founding pillar of democracy is honesty & integrity of public servants. When criminals become public servants , indulges in corrupt , criminal practices democracy fails. Such corrupt public servants are Inhouse enemies , traitors and cause more damage to national security than terrorists , naxalites or enemy armies. Which court dares to hang such corrupt public servants?
Government money in public exchequer is hard earned money of public (irrespective of caste or religion) collected by way of taxes. Governments , Ministers are just custodians , trustees of public money. They must judiciously use it for public welfare not public appeasement. A wrong act of government supported by majority doesn't become right by virtue of it's supporting numbers. It is illegal.
Many state governments are doling out freebies like free electricity , free bus travel , free monthly money. Governments have even waived off loans. Apart from this one government gives crores of rupees grant to religious bodies affiliated to one religion while denying parity to other religions. When other government comes to office they do vice versa.
If political parties want to appease their supporters let them do it from their personal properties and their party funds but not from public exchequer.
To manage all these foolish acts governments increase tariffs burdening the gullible public. Above this governments also take loans , again this burden also falls on the public.
2. Question(s) of Law:
Why should we the public who are not beneficiaries of these freebies take the burden of freebies given to undeserving people ?
3. Grounds:
Requests for safeguarding public exchequer.
4. Averment:
If government wants to give free bus travel to women , limit it to women in low paying jobs like house maid , garment workers , workers of small scale industries.
If government wants to give free electricity limit it to houses of BPL families.
If government wants to give monthly payouts to women , give it as loan to start small business like fruit vending , tea shop , tailoring , etc.
If government wants to help farmers don't waive off their loans. Instead pay premiums of farm insurance , increase minimum support price , facilitate marketing their produce.
Government must never indulge in management of religious bodies , never give grants to temples , mutts , darghas and mosques. If government has surplus funds to donate it to religious bodies use it to strengthen government hospitals , to build separate toilets for girls in government schools.
Government should never rob Peter to pay Paul.
5. PRAYER:
In the above premises, it is prayed that this Hon'ble Court may be pleased:
a . Hereby , I do request the honorable supreme court of India to consider this as a PIL for : “writ of Mandamus” and to issue instructions to the concerned public servants in the above mentioned cases to perform their duties & to safeguard public exchequer.
b . to pass such other orders and further orders as may be deemed necessary on the facts and in the circumstances of the case.
c. to order state governments to first conduct transparent scientific survey, census of populace to identify where government support is needed , to draw parameters for identification of needy and to conduct public / online hearing for public objections before giving public money , monetary support to identified beneficiaries.
d. to prohibit state governments from giving grants to religious bodies.
e. to prohibit state governments from waiving off farmer loans.
FOR WHICH ACT OF KINDNESS, THE PETITIONER SHALL BE DUTY BOUND, EVER PRAY.
