1. That the Petitioner is filing the present Writ Petition in Public Interest under Article 32 of the Constitution of India seeking mandamus to cancel / struck down the contradictory laws or amendments like article 15 / 16 , sc st atrocities prevention act , sc st atrocities prevention act 2018 by Union government state governments to the central / State
thereby violated Human rights / Fundamental right guaranteed to citizens of India under Article 14, 19(1)(g) and 21 of the Constitution.
2. Petitioner is a Citizen of India. Petitioner Nagaraja Mysore Raghupathi is a digital journalist & human rights activist. He is residing at # LIG 2 NO 761 LAXMIKANTANAGAR HEBBAL MYSORE - 570017 KARNATAKA . The average annual income of the Petitioner for the last financial year (FY-2024-2025) is approximatenumbs.500000/- and PAN number is AHOPN0097P. The Petitioner's National UID / AADHAR number is 570353393479.
3. The Case in Brief and facts constituting the cause of action
Every human being gets human rights by birth , it is not given by ambedkar or government. All are born equal. Nobody , no ambedkar , no government has right , authority to snatch away those rights. Nobody , no so-called upper castes can snatch away the human rights of people citing their lower caste.
Violators of human rights are criminals. Ambedkar , parliamentarians since Constituent assembly to the parliamentarians till date are violators of human rights. Therefore they are criminals.
When a crime is supported by majority people , majority voters doesn't become legal. Hitler had majority support in german parliament & society in his acts of annihilation of Jews , still it was inhuman , illegal.
By misusing SC ST preventions of atrocities act many SC / ST people are committing crimes and going unpunished. Read following websites about crimes committed by dalit oppressors , dalit rowdies , dalit goondas.
Indian Constitution by Article 14 guarantees Right to equality in contradiction Article 15 & 16 makes SC ST people more than equals.
Our double standard constitution preaches equality but practices double standards.
There are different property , marriage laws for people of different religions , different castes.
There are different laws for management of religious places for different religions.
Discrimination of SC ST by other communities is a crime. But within SC fold there are sub castes , discrimination of left hand dalit by right hand dalit is not a crime , discrimination of SC Madiga by SC holeya is not a crime , discrimination of SC madiga by SC mahar is not a crime. It doesn't attract sc st atrocities act.
People of other communities making casteist slur , discrimination against SC people is a crime whereas SC people making casteist slur, discrimination against people of other communities is not a crime.
Our colonizers britishers invented divide & rule policy to subjugate us and enacted SC ST reservation policy. Ambedkar , Drafters of our constitution continued divide & rule by including it in draft constitution , same british intent was carried forward by members of Constituent Assembly who approved that draft constitution and parliamentarians till date are using same british divide & rule policy by making more amendments.
Our freedom fighters struggled sacrificed for independent bharath where everybody are equal not for any dalitstan , muslimstan where muslims dalits are superior committing Atrocities against other communities.
Our constitution instead of annihilating caste and establishing equal society has reinforced caste divisions , caste identities.
Caste discrimination against SC ST people are inhuman and perpetrators must be punished. In the same way caste discrimination against other communities by SC ST people are also inhuman and perpetrators must be punished.
Caste reservation policy by government is snatching away meal plate from hungry other community child to feed SC ST child. Other community child dies hungry.
Caste reservation policy by government is in the name of SC ST empowerment , breaks the legs of other community athlete to ensure victory of SC ST athlete in the game.

4. Source of Information: The Petitioner relies on Acts, Amendment Act, Rules and Amendment Rules passed by Parliament, published in Official Gazette through ordinances by the Central Government, Acts, amendment Acts, Rules and Amendment Rules passed by the state governments and published in official gazette, observations of some Newspapers etc as well as personal knowledge and experience.
5. Details of Remedies Exhausted: The Petitioners have not approached any court of authority for remedy against the issues raised in this Petition. That the Petitioner does not have any alternative equally efficacious remedy other than to approach this Hon'ble Court than by way of filing this writ petition under Article 32 of the Constitution of India.
6. That the present petition will be beneficial for all citizens of India as the amendments in Central Act, Central Rules, State Acts and State Rules are adversely affecting their fundamental rights.
7. Nature of Personal Interest, if any, of the Petitioner: The Petitioners have no personal interest in this Petition and it is being filed in Public Interest.
8. That the Petitioners have not filed any other writ petition same or similar to the present writ petition, neither in this Hon'ble Court nor in any other Court or forum across the land.
9. The Petitioner declares that the issue raised was neither dealt with nor decided by a Court of law at the instance of the petitioner or to the best of his knowledge, at the instance of any other person.
10. The Petitioners have not approached any authority for relief for the subject matter of this petition.
11. That the Petitioner is filing the instant Writ Petition inter alia on the following amongst other grounds:-
GROUNDS
A. Because Article 15 & Article 16 central Act sc st prevention of Atrocities Act 1989 & 2018 and overrides all state Acts and rules. The amendment made by states in Act and Rules through ordinances under Article 254(2) of constitution conflicting with Central Act and the9 amendments contradicting the central Act and State Act are liable to deleted.
B. Because the states cannot use concurrent list used to modify the state Act, if the state Act conflict with Central Act.
12. GROUNDS FOR INTERIM RELIEF
A. Because the amendments made in sc st prevention of atrocities Act 2018 and Rules by the State Governments is adversely affecting the interest of the unreserved community members of the country, their fundamental rights are affected and are suffering injustices , crimes perpetrated by SC st people , urgent intervention of this court is necessary.
B. As explained in the main grounds of the Petition, the unreserved community citizens of the country deserve to get immediate relief from this Hon'ble Court.
13. MAIN PRAYER
In light of the aforesaid, the Petitioner, therefore, pray that this Hon'ble Court may kindly be pleased to:
a. Issue a writ of Mandamus or any other appropriate writ, order or direction in the nature thereof, declaring that the SC st prevention of Atrocities Act 2018 and Rules made by States by amending the original central Act, passed by the Parliament, overrides the central act, are illegal and deserves to struck down;
b. Issue any other appropriate writ, order or direction as the nature and circumstances of the present case may require;
c. Issue a writ of Mandamus to Union Government of India to legislate Uniform Civil Code & Uniform Criminal Code where in all citizens are treated in a equal , fair manner discarding all religious , caste , regional identities.
14. INTERIM PRAYER
In light of the aforesaid, the Petitioner, therefore, pray that this Hon'ble Court may kindly be pleased to:
a. Issue a writ of Mandamus or any other appropriate writ, order or direction in the nature thereof, restoring the original central act and central rules in all states which have amended the state / acts rules and should be in force till the present Petition is finally adjudicated;
b. Issue any other appropriate writ, order or direction as the nature and circumstances of the present case may require;

Nature has given birth to all of us as human beings as equals. From birth we are all equals. Nobody , no caste is great , superior or inferior. All are equal. All must be respected & treated equally.
By birth we all have human rights , right to equality , right to equal justice , etc. Nobody , no ambedkar , no government , no court of law has authority to violate human rights of people. They become criminals When they violate people's human rights. Already they are criminals by violating our human rights.
Caste Hatred is a criminal offence. Dalits are regularly indulging in spewing caste venom , but governments, police are not taking action. Crime supported by majority dalits doesn't make the crime just & legal. Dalit burning religious books , dalit making derogatory remarks against hindu deities , gods , dalits indulging in violence against others , no action by police & governments.
Why this double standards ?
See the culture , vocabulary of dalits on social media , dalits are not oppressed but themselves are oppressors of innocents.
Hereby we request Union Home Minister , Government of India , All State governments & Supreme court of India to answer following questions :
Who gave you authority to suppress , violate human rights of others by reservation policy ?
Is not celebrating victory of enemy forces an anti national act ? Why government is celebrating Bhima koregoan victory of british army over native army ?
Correspondence between ambedkar and british government proves ambedkar was against India's Independence struggle. Then why government gave him bharatha rathna award ? Because he represented a major dalit vote bank ?
Buddhism and Christianity as a religion doesn't have caste divisions all are same equal. Dalits after conversion to Buddhism & Christianity are still enjoying reservation benefits , is it not illegal ? Why government is not taking action ?
Government in various admission / recruitment process has fixed low cut off marks , extra attempts , maximum age relaxation to dalit candidates. Nature has produced all human beings as equals with equal intellect. Does the government view dalits as less intelligent ? On what scientific study basis ?
Government in various schemes gives cash support to dalits irrespective of their economic stature as government of Karnataka gives premium waiver to yasaswini health insurance scheme , cash payments for rare health diseases costing lakhs of rupees for treatment. All for dalits only. Not for suffering patients belonging to other castes. On what scientific basis these schemes are based ?
Did Ambedkar alone wrote constitution of india or B N Rao , members of committees also wrote it ?
Why don't government treat dalit , upper caste , muslim , brahmin , tribes all as equals through it's policies ?
Why government differentiate , discriminate people on the basis of caste , religion ? For vote bank ?
When government itself doesn't practise equality , how do you enforce it ?
What action taken against dalit rowdies , dalit criminals and Bhim Army for threatening people , attacking others ?
Are fundamental rights only for dalits , not for Others ?
Are not public servants ashamed after taking lakhs of rupees pay & perks fail to do their duties without any bias , partiality ?
Does government , courts of law has authority to punish a person for crime may be committed by his grandfather centuries ago ? There were many criminal tribes in the past , can we today ask for punishment for descendants of those tribes & claim compensation from government ? Is it not foolish ? Exactly that foolish Act is being done by government today.
